Spring Break Possession

   Many kids are out on Spring Break this week. Under the Texas Family Code the parent with a possession schedule get the kids this week. §153 of the Texas Family Code contains what Texas calls the "Standard Possession Order." The SPO is what parties follow when they have orders but do not have agreements for possession. In even number years, the parent with the possession schedule is awarded Spring Break.  

    If the parties live within 50 miles of each other the Code presumes you will pick up the kids from school the day school is let out for Spring Break and keep the kids until 6:00 PM the day before school resumes. 

    This is the same for the parent with whom the kids primarily live with in odd number years. If the children are not enrolled in school, the parties are ordered to follow the calendar for the school district in which the children live.  Whether you are planning on a staycation or a trip out of town, you want to know when your possession begins and ends. As always, the Family Code wants the parties to reach their own agreeemt when they can. The less conflict there is between parents; the better it is or everyone, especially the children.
